The Colorado Trial Lawyers Association nominated Winston v. Polis as a Case of the Year Finalist for 2020-2021. Winston is a class action lawsuit against the Department of Corrections and Governor Polis for the failure to protect people incarcerated in the state from COVID-19, resulting in massive outbreaks of infection and suffering, and causing at least 29 deaths.
The lawsuit was filed by Maxted Law LLC, the ACLU, Holland Holland Edwards and Grossman, Killmer Lane and Newman, Finger Law, and the Denver College of Law Civil Rights Clinic. This team secured a consent decree against the DOC requiring significant protections for incarcerated persons, monitoring and auditing of the DOC’s handling of COVID-19, and many other conditions. The case against the Governor is ongoing with a recent victory in the Court of Appeals which has revived the case.
